What is a Divorce Certificate?

A Pakistan Divorce Certificate (Talaqnama) is the official legal document proving a marriage has been lawfully dissolved under Pakistani law and Islamic Shariah. Issued by the Union Council after the process completes and Iddat passes.

For overseas Pakistanis, it is essential for remarriage, Spouse Visa applications, legal name change, inheritance matters, and proving divorced status in the UK, USA, UAE, Canada, and Europe.

  • Talaq (Husband-initiated): Registered after 90-day Union Council process
  • Khula (Wife-initiated): Court decree — we handle the full process
  • Mutual Divorce: Fastest option — both parties agree
  • Embassy Accepted: After Foreign Office attestation — valid globally

❓ COMMON QUESTIONS

Divorce Certificate FAQs

Q. My husband pronounced Talaq verbally — is it legally effective?
Not until registered. Under the Muslim Family Laws Ordinance 1961, verbal Talaq only becomes legally effective after it is reported in writing to the Union Council. If unregistered, the divorce has no legal standing for remarriage, visa, or property purposes. We can register it on your behalf — even years later.
Q. Can a wife get Khula without the husband's cooperation?
Yes. A wife has the right to seek Khula through the Family Court even if the husband refuses. We represent clients in Pakistani Family Courts in absentia — no travel needed. The process typically takes 3–6 months depending on the court schedule.
Q. How long does the Talaq process take?
The mandatory 90-day waiting period begins from when the notice reaches the Union Council. After 90 days (if reconciliation fails), the divorce becomes effective and the certificate is issued within 1–2 weeks. Total: approximately 3.5 to 4 months. Attestation and DHL delivery add another 10–15 working days.
Q. Is a UK/US court divorce valid in Pakistan?
Generally yes, but it must be formally recognised in Pakistan. A foreign divorce decree can be registered through a specific legal process. Without this, it may not be accepted for remarriage in Pakistan or by Pakistani embassies. Contact us with your decree for a free assessment.
Q. My divorce happened 5 years ago — was never registered. Can I get a certificate now?
Yes. Late registration of Talaq is very common among overseas Pakistanis. We prepare affidavits, gather witness statements, and file with the Union Council with an explanation for the delay. We handle this regularly for clients who divorced years ago but never formalised it.
Q. Do I need a Divorce Certificate to remarry in Pakistan?
Yes, absolutely. Before registering a new Nikah Nama, the Union Council and Qazi will require your Divorce Certificate as proof the previous marriage is dissolved. Once we obtain your certificate, we can immediately process your new Nikah Nama or Online Nikah.
