What is khula?

Khula is the right of a Muslim wife to end her marriage through the Family Court when she does not wish to continue it. It is granted under the Dissolution of Muslim Marriages Act, 1939 and the Family Courts Act, 1964. You do not need your husband’s agreement, and you do not need to be in Pakistan.

  4. Reconciliation and decree. If reconciliation fails, the court passes a khula decree. You do not need to attend the hearings in most cases.
  5. Union council process. The decree is sent to the union council. After the legal waiting period the divorce becomes effective.
  6. NADRA divorce certificate. We get your divorce registered with NADRA and send you the computerised divorce certificate.

His full name, CNIC number if known, and last known address in Pakistan or abroad.

Names and dates of birth, in case maintenance or custody also needs to be decided.

Sign the power of attorney at the Pakistan High Commission in London or a Pakistani consulate in the UK.

USA and Canada

Sign at the Pakistani embassy or a consulate in the US or Canada. We courier the documents both ways.

Sign at the Pakistani embassy in your country, for example in Spain, Italy, Greece, Germany or Norway.

The total cost depends on the city, whether your husband contests the case, and whether maintenance or custody also needs to be decided. Khula FAQs

Can I get khula in Pakistan without coming back?

Yes. You sign a special power of attorney at the Pakistani embassy or consulate where you live, and your advocate files and runs the khula case in the Family Court in Pakistan. In most cases you do not need to appear in person.

How long does khula take for overseas Pakistanis?

It depends on the court and on whether the husband appears and contests. If reconciliation fails, the Family Court can decree khula at the pre-trial stage. After the decree, the union council process and NADRA registration take further time. We give you a realistic timeline after reviewing your case.

Do I have to return the haq mehr?

In a khula, the court can ask the wife to return the haq mehr or benefits she received from the husband. The exact amount depends on your case and the court’s decision. We explain this before you file.

What if my husband lives abroad too?

The case can still be filed in Pakistan. If the husband cannot be served at a known address, the court can allow notice through other means, such as publication in a newspaper.

Will my khula be accepted in the UK, USA or Canada?

A Pakistani court decree followed by a NADRA divorce certificate is the usual proof of a khula. Each country has its own rules for recognising foreign divorces, so check with an immigration or family lawyer where you live.
