
“Court marriage” is one of the most searched legal terms in Pakistan, and also one of the most misunderstood. This guide explains what a court marriage in Pakistan really is, who can do it, the step-by-step procedure, the documents you need, how long it takes, what affects the cost, and what overseas Pakistanis should know.
What is a court marriage in Pakistan?
Despite the name, a court marriage is not a separate kind of marriage and a judge does not marry you. It is a nikah between two adults who marry by their own free will, usually arranged with the help of a lawyer, often at or near the court premises. The nikah is performed by a nikah khawan, written on the official nikahnama and then registered with the union council under the Muslim Family Laws Ordinance, 1961.

Who can do a court marriage?
- Both partners must be adults. We only handle marriages where both are at least 18. In Sindh the minimum age for marriage is 18 for both, and marrying a minor anywhere in Pakistan can lead to criminal liability.
- Both must consent freely. No one can be married by force or pressure.
- An adult woman can marry without her wali’s consent. Pakistan’s superior courts have upheld this for adult Muslim women.
- A woman must not already be married, and a divorcee or widow must have completed her iddat.
- A man who is already married needs permission from the Arbitration Council before a second marriage. Read is second marriage legal without the first wife’s permission.
Court marriage procedure: step by step
- Consult a lawyer. The lawyer checks that both of you are eligible and explains the process.
- Prepare affidavits. Each partner signs an affidavit confirming age, marital status and that they are marrying by free will.
- Arrange witnesses. Two adult Muslim witnesses attend with their CNICs.
- Perform the nikah. A nikah khawan performs the nikah, the haq mehr is agreed, and the nikahnama is filled in and signed by both partners and the witnesses.
- Register the nikah. The nikah registrar registers the nikahnama with the union council.

How long does a court marriage take?
If all documents and witnesses are ready, the nikah itself can usually be done on the same day. Registration with the union council and the NADRA marriage certificate normally follow within a few days to a few weeks, depending on the office. Missing documents, a previous marriage that is not properly ended, or a dispute with the family can add time.
What does a court marriage cost?
There is no single fixed fee. The total usually includes the lawyer’s fee, the nikah khawan, union council registration and NADRA fees, and stamp paper for affidavits. Court marriage for overseas Pakistanis
- If both partners are in Pakistan, the procedure is the same as above.

- For a spouse visa, embassies usually ask for the NADRA marriage certificate, and sometimes for it to be attested by the Ministry of Foreign Affairs.
- Make sure the nikah is registered. An unregistered nikah causes problems with visas, NADRA records and later family matters.
If your family objects or threatens you
Many court marriages happen because a family disagrees. Adults have the right to marry by choice, and if you face threats or a false case after marriage, you can approach the court for protection and to quash false FIRs. Talk to a lawyer before the marriage so you are prepared.
